Welcome to Proptefy. These Terms of Service ("Terms") govern your access to and use of our website and services. By using Proptefy, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Proptefy, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not access or use our services. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of any changes.

2. Account Registration

To use Proptefy as a real estate agent, you must create an account and provide accurate, complete information. You agree to:

  • Maintain the security and confidentiality of your account credentials.
  • Provide and maintain accurate and current professional information, including your real estate license details.
  • Promptly update your information if it changes.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account.

3. Fees and Payment

Proptefy operates on the following fee structure:

  • Verification Fee: A one-time, non-refundable fee of $29.00 is required to complete the license verification and account activation process. This fee is processed through Stripe.
  • Lead Subscription: After verification, agents pay a one-time $1.00 fee to unlock the leads portal. No additional per-lead charges are incurred.
  • All fees are in U.S. dollars. We reserve the right to modify our fee structure with 30 days' written notice.

4. Lead Distribution

Proptefy matches and distributes leads based on agent service areas, expertise, and availability. Regarding leads:

  • Each lead is assigned to one agent on an exclusive basis.
  • Lead quality is maintained through verification processes, though we do not guarantee conversion or outcome.
  • Leads are matched based on geographic service area, so agents only receive relevant leads.
  • We reserve the right to adjust lead distribution algorithms to optimize platform performance.

5. Referral Fees

In certain cases, referral fees may apply. When a transaction results from a Proptefy lead connection, agents acknowledge that:

  • Referral fees, if applicable, will be clearly disclosed in advance through the Referral Agreement.
  • Agents are responsible for compliance with their state's real estate commission rules regarding referral fees.
  • Referral fee arrangements are separate from the lead subscription fees.

6. Intellectual Property

All content, trademarks, logos, and intellectual property on Proptefy are owned by or licensed to us. You may not copy, modify, distribute, or use any of our intellectual property without prior written consent. The Proptefy name, logo, and related marks are our exclusive trademarks.

7. Limitation of Liability

To the maximum extent permitted by law, Proptefy and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim. We do not guarantee the quality, accuracy, or completeness of any leads or the success of any real estate transaction.

8. Termination

Either party may terminate this agreement:

  • You may cancel your account at any time from your dashboard or by contacting support.
  • We may suspend or terminate your account for violation of these Terms, fraudulent activity, or conduct harmful to other users or the platform.
  • Upon termination, your right to use the platform ceases immediately. Leads already assigned to you remain yours.
  • Outstanding fees remain payable upon termination.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of Proptefy shall be resolved in the state or federal courts located in Travis County, Texas.
